User Agreement
Effective Date: Sep 1st 2023
This User Agreement (“Agreement”) is entered into by and between Twinerlite LLC, a Colorado limited liability company (“Company,” “we,” “our,” or “us”), and any individual accessing or using our website and services (“User,” “you,” or “your”).
By accessing or using our services, you agree to be bound by this Agreement. If you do not agree, do not use the services.
1. Services
We provide online writing assistance tools, including grammar checking, plagiarism detection, AI-generated content detection, paraphrasing, summarization, formatting, and related features (the “Services”). We do not provide downloadable software.
2. Eligibility
The Services are intended for individuals 13 years of age or older. By using the Services, you represent that you meet this requirement.
3. Accounts
- Accounts are personal and non-transferable. Shared accounts are not permitted.
- You are responsible for maintaining the confidentiality of your login credentials.
- We may suspend or terminate accounts for violations including, but not limited to: misuse, automated scraping, or attempts to use the Services for academic dishonesty.
4. Subscriptions, Payments, and Refunds
- Subscriptions are billed through Stripe and will auto-renew unless cancelled.
- Refunds may be requested within 14 days of initial purchase, subject to our review.
- Refunds are not guaranteed and will be granted only where legally required or at our sole discretion.
5. Acceptable Use
You agree not to use the Services for:
- Violating laws or regulations.
- Academic dishonesty (submitting generated work as your own in violation of school policies).
- Disrupting, damaging, or interfering with the Services.
6. Intellectual Property
All rights, title, and interest in the Services and their content remain the property of Twinerlite LLC. Users may not copy, modify, distribute, or reverse-engineer any part of the Services.
7. Disclaimers
The Services are provided on an “as-is” and “as-available” basis. We make no warranties of any kind, express or implied. We do not guarantee accuracy of outputs, fitness for a particular purpose, or compliance with any academic standards.
8. Limitation of Liability
To the fullest extent permitted by law, Twinerlite LLC and its affiliates, directors, employees, and agents shall not be liable for any damages, including but not limited to direct, indirect, incidental, or consequential damages, arising from use of the Services.
9. Termination
We may suspend or terminate your access at any time, with or without cause, notice, or liability.
10. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Colorado, United States, without regard to conflict of laws principles.
Additional Liability Limitation Clauses (International)
1. No Professional Advice
The Services are provided for educational and informational purposes only. We do not provide legal, academic, medical, or professional advice. You agree not to rely on the Services as a substitute for such advice.
2. Local Law Compliance
You are solely responsible for ensuring that your use of the Services complies with all applicable laws, regulations, and institutional rules in your jurisdiction. We make no representations that the Services are appropriate or available for use outside the United States.
3. Maximum Liability Cap
To the fullest extent permitted by law, in no event shall Twinerlite LLC’s total liability arising out of or related to the Services exceed the greater of (i) the amount you paid us in the past three (3) months or (ii) fifty U.S. dollars (USD $50).
4. Indemnification
You agree to indemnify, defend, and hold harmless Twinerlite LLC and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising from your use of the Services, your violation of this Agreement, or your violation of any rights of another.
5. International Use Disclaimer
Twinerlite LLC expressly disclaims all liability for any damages, penalties, or legal consequences arising from use of the Services in countries with restrictive academic integrity, AI, or data protection regulations.
6. Severability (GDPR / Consumer Law carve-out)
If any provision of this Agreement is held unenforceable under consumer protection or data protection laws (including GDPR in Europe or similar regimes), the remaining provisions shall remain in full force and effect, and our liability shall remain limited to the maximum extent permitted by applicable law.
